Welcome to Digitalconstructive.com. The Digitalconstructive.com website (the "Site") is comprised of various web pages operated by Framework Publishing LLC. Digitalconstructive.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of digitalconstructive.com constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference.

Digitalconstructive.com is an educational blog, resource, and e-commerce site. Providing accurate and up to date examination preparation materials for Construction Contractors.

Your use of digitalconstructive.com is subject to Framework Publishing LLC's Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

Electronic Communications

Visiting digitalconstructive.com or sending emails to Framework Publishing LLC constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.

I understand that digitalconstructive.com is owned by Framework Publishing LLC. Furthermore, I understand that purchase of this home study kit is in no way a guarantee of passing the California Contractor License Examination. I also understand that no employee of Framework Publishing LLC may make any promises or representations other than those stated above.

Further, by accepting the Terms and Conditions, I am demonstrating both: (a) my knowledge that I need four (4) years journeyman experience to qualify to take the California Contractors State License Board examination and, (b) my understanding that it is my responsibility to provide the necessary documentation attesting to this requisite work experience.

Children Under Thirteen

Framework Publishing LLC does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use digitalconstructive.com only with permission of a parent or guardian.

All content included as part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of Framework Publishing LLC or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.

You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. Framework Publishing LLC content is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use, and will make no other use of the content without the express written permission of Framework Publishing LLC and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of Framework Publishing LLC or our licensors except as expressly authorized by these Terms.

International Users

The Service is controlled, operated and administered by Framework Publishing LLC from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the Framework Publishing LLC Content accessed through digitalconstructive.com in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

Indemnification

You agree to indemnify, defend and hold harmless Framework Publishing LLC, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Framework Publishing LLC reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Framework Publishing LLC in asserting any available defenses.

Class Action Waiver

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Framework Publishing LLC agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

Liability Disclaimer

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. FRAMEWORK PUBLISHING LLC AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.

FRAMEWORK PUBLISHING LLC AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND. FRAMEWORK PUBLISHING LLC AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FRAMEWORK PUBLISHING LLC AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF FRAMEWORK PUBLISHING LLC OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.

I understand access to my online practice examinations will commence when I activate the code included with my study materials. Study materials will ship between 3-5 business days. I also understand that it is my responsibility to notify support@digitalconstructive.com if I do not receive them.

I understand that this purchase does not include any additional services apart from the delivery of Contractor License Exam Preparation Study Materials. I also understand that the Contractors State License Board reserves the right to deny licensure at their discretion and this is in no way related to Framework Publishing LLC.

Courses Offered by AthomePrep

Refunds/Exchanges/Returns Because we are distributing non-tangible irrevocable goods, for courses designed to help you pass an exam, we maintain a no-refund policy. A refund can only be granted if less than 10% of the courses has been accessed and if our office has been contacted within 30 days from the date of purchase. Pre-highlighted/tabbed materials WILL NOT be eligible for refunds. There is a 5% restocking fee for all returns RECEIVED back in our office within 30 Days of purchase date (this covers our Credit Card charges). There is a 20% restocking fee for all returns RECEIVED back in our office within 90 Days of purchase date. After 90 Days, we do not accept returns on books. When returning a FREE shipping item, the cost of the original shipping will be deducted from the refund. No Pass No Pay In accordance with the Tennessee State Contractors Licensing Board, our No Pass No Pay guarantee DOES NOT apply to Tennessee pre-licensing/exam review courses. For all other states and exam review courses, if you do not pass your exam on the SECOND attempt, we will refund your course fee. Textbooks, shipping, and tabs are non-refundable. To qualify for the NO PASS – NO PAY Guarantee, you are required to do the following:

Receive a minimum of 90% on all practice quizzes.
Submit your original results to our office within 10 days of the exam.
Do not access the course after your exam (if you failed).
Purchase and use our permanent tabs.
Purchase and use ALL state approved references during your exam.

We are committed to your success. If you do not pass, you have the option of a free course extension. Pre-Licensing and Continuing Education courses do not qualify for the No Pass, No Pay guarantee. Program Changes @ Home Prep, a Division of Stautzenberger College reserves the right to change instructors, discontinue courses, refuse enrollments or extensions, or adjust service fees and textbook prices listed as circumstances warrant. Courses will be updated as new information is discovered and as textbooks change. If a textbook changes, the student is responsible to obtain the correct edition for their exam. Returned Check Policy There is a $30 service charge for any returned check no matter the reason. The administrative fee increases to $40 if the check is not redeemed within two weeks of notification. A returned check will automatically place a hold on your participation and legal action will be taken against the writer of the check. All legal fees associated with filing a claim against the check writer will be passed on to said check writer. Continuation and Extensions All of our courses come with 12 months of initial access. A one-time free 30 day extension will be considered in certain cases of hardship. If the student needs additional time beyond this, the course will be 50% off for another 1 year. If a textbook changes, the student is responsible to obtain the correct edition for their exam. Promotional Emails By making a purchase on our site, you will be automatically enrolled into our email system to receive promotional offers and reminders for renewing your license. You can opt-out at any time. Privacy Policy @ Home Prep, a Division of Stautzenberger College, maintains a very stringent privacy policy. Information that we receive from you or your company will not be rented, sold, or shared with anyone. This includes any non affiliated or third parties. An exclusion to this policy will be if in the event it is to provide you with a service that you have requested. For example, if a publisher needs to drop-ship an order directly to you. Unless we are asked not to, it is possible that we will contact you in the future (via fax, email, telephone, or letter) regarding special promotions on products or services. Please contact us with any further questions. Shipping and Orders Please note the following shipping definitions: We do not offer Saturday delivery. Next Day Air (Saver) – Next business day delivery by end of day. 2nd Day Air – Delivery by the end of the second business day. Ground – Day-definite delivery typically in one to five days. We make every attempt possible to ship your order within 24 hours. Orders classified as “special order” are usually shipped within 7-10 days. Express orders placed after 3pm EST will not be shipped until the following business day.

Termination/Access Restriction

Framework Publishing LLC reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of New York and you hereby consent to the exclusive jurisdiction and venue of courts in New York in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Framework Publishing LLC as a result of this agreement or use of the Site. Framework Publishing LLC's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Framework Publishing LLC's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Framework Publishing LLC with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Should the time limit of my online practice exam (365 Days) from the date of purchase expire. I understand that to renew access will cost an additional fee at the discretion of Framework Publishing LLC. I understand that all sales are final. All sales are final.

Refunds and Exchanges may be available for study materials only if they are returned to our publisher at the customer's expense. Materials must be unused and in new condition. Our publisher will determine if the materials are unused and in new condition. Refunds will be for the cost of the materials and sales tax paid ONLY. The cost of shipping paid at the time of purchase will not be refunded.

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Framework Publishing LLC with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Framework Publishing LLC with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.

This contract is a legally binding instrument when accepting the Terms and Conditions. I acknowledge and understand there is no “cooling off” period and that notwithstanding any third party arrangement or assignment of tuition reimbursement/ assistance, I am fully responsible for all charges, fees, and conditions of this enrollment agreement.

Changes to Terms

Framework Publishing LLC reserves the right, in its sole discretion, to change the Terms under which digitalconstructive.com is offered. The most current version of the Terms will supersede all previous versions. Framework Publishing LLC encourages you to periodically review the Terms to stay informed of our updates.
